論説(Article)本稿では、簡易裁判所における法的救済の基本的なあり方、すなわち「簡易救済」について、考察を加えることを目的とする。簡易裁判所については、創設以来、「少額裁判所的性格」と「小型地裁的性格」という役割の二重化・複合化が進んでいるが、本稿では、それらに加えて、簡易裁判所の「多様な市民ニーズ即応的性格」とその実効化について、総論的・各論的に探究したい。This article has the aim to find and create new functions of the summary courts in Japan from historical, theoretical and practical viewpoints of civil remedial process. Although the summary courts is one of the successful courts after the World War Ⅱ, I propose several reforms in order to promote the simple and just remedy in the field of civil proceedings of summary courts.
